a) An employee was promoted to a higher
category without availing Automatic Advancement Scheme and he worked in the
promotion category for three years but due to domestic problems be requested for
reversion. Later he requested for Special Grade Post Scale in the lower cadre
after reversion stating that the service rendered in the higher category can be
counted for purpose of increments in the lower cadre on reversion, as per F.R.
26(c).
b) An employee availed Special Grade Post
Scale on completion of 8 years of incremental service. Subsequently, it was
noticed that the name of the individual was not considered for regular
promotion in the D.P.C., conducted, before giving him Special Grade Scale and
promotion was not given because of the disciplinary case pending against him.
The Head of Department took the stand that the very purpose of Automatic
Advancement Scheme is to relieve stagnation and therefore, since he was given an
opportunity for promotion and he could not avail it, therefore, he should not
be eligible for Automatic Advancement Scheme. Therefore, the Special Grade Post
Scale given to him was cancelled.

Special Grade Scale Post: (A) If an Employee is promoted to the higher post on
regular line from the Ordinary Grade Scale Post but he relinquishes his
promotion under General Rules 45 of A.P. State and Subordinate Service Rules
or seeks reversion at his own request and when his pay has been fixed under F.R.26(c)
in the lower category, is the employee eligible for Special Grade Post scale
/ Special Promotion Post Scale-I / Special Promotion Post Scale-II in the
lower category?
(B) If an Employee is promoted to the higher post from
the Spl. Grade Scale Post but he relinquishes his promotion under Genl. Rule
45 of AP State and Subordinate Service Rules or Seeks reversion at his own
request and his pay is fixed under FR 26(c) in the lower category, is the
employee eligible for continuation of Spl. Grade Post Scale and for sanction of
SPP-I / SPP-II scale in the lower category?

NO. The employee is not eligible for any kind of benefits
under Automatic Advancement Scheme, because the main aim of the Scheme is to
relieve the stagnation in Service. The employee has been given an opportunity
for promotion, but he relinquished it. Hence such of the employees are not
eligible for Special Grade Post Scale / S.P.P-I / S.P.P-II under Automatic Advancement
Scheme.
The employee is eligible to continue to hold the special Grade Scale post in the lower category, but he is not eligible for S.P.P.-I & S.P.P.-II scales under Automatic Advancement

If an Employee is promoted to the higher post from the Spl.
Promotion Post Scale-I but he relinquishes his promotion on regular line
i.e., 1st Level Promotion Post on regular line, under Genl. Rules 45 of AP
State and Subordinate Service Rules or seeks reversion at his own request and
his pay is fixed under FR 26(c) in the lower category, is the employee eligible
for continuing to hold Special Promotion Post Scale-I in the lower category?

The employee is eligible for continuing to hold the Special Promotion Post Scale-I in the lower category, because his relinquishment to the promotion post has prospective effect. The individual is not eligible for further S.P.P.-II Scale under Automatic Advancement Scheme. |

Spl. Promotion Post Scale-II If an employee is promoted from the Spl. Promotion Post
Scale-II to regular line of promotion, whether the employee is eligible for further
A.A. Scheme benefits in the promotion post or not?

NO. The employee is not eligible for further A.A. Scheme benefits in the Promotion Post, because he has already availed Spl. Grade Post Scale, S.P.P.-I & S.P.P.-II benefits under Automatic Advancement Scheme in the lower category. |

Disciplinary Case Pending:
If an employee is otherwise eligible for promotion to the
higher post on regular line from the Ordinary Grade Scale Post but his name
is not approved in DPC, due to disciplinary case pending against him and his
juniors are promoted in the same DPC, whether the individual is eligible for
sanction of Special Grade Scale or not?

The individual is not eligible for Special Grade Post Scale as he has not stagnated in service but could not be considered for promotion due to his mis-conduct and there by not promoted along with his juniors. |
