Sub:- Public Services-Disciplinary Cases-Placing the accused officers on defence before the Tribunal for Disciplinary Proceedings - Format prescribed - Communicated.

The disciplinary cases emanated out of investigations by the Anti-Corruption Bureau or otherwise for imposing any of the penalties specified in Clauses (vi) to (x) of rule 9 of the Andhra Pradesh Civil Services (CC&A) Rules, 1991 are required to be inquired into either by appointing Departmental Enquiry Officers or by the Commissioner of inquiries or by placing the accused officers on his defence before the Tribunal for Disciplinary Proceedings. In G.O.Ms.No.82, General Administration (Services.C) Department, dt.01.03.1996, A format for appointment of Inquiring Authority was also prescribed.

2.   Under Sub-rule (I) of rule 3 of the Andhra Pradesh Civil Services (Disciplinary Proceedings Tribunal) Rules, 1989 and instruction 8 (8) and 8 (9) of the Andhra Pradesh Vigilance Commission Procedural Instructions, the Government is empowered to take a decision in consultation with the Vigilance Commissioner, Andhra Pradesh Vigilance Commission for placing Government Employee or Employees on defence before the Tribunal for Disciplinary Proceedings.

3.  Accordingly, a format to place the accused Government Employee or Employees on defence before the Tribunal for Disciplinary Proceedings is Annexed to this U.O. Note.

4. The Departments of Secretariat are requested to follow the format, while issuing orders entrusting the disciplinary case, for detailed inquiry, to the Tribunal for Disciplinary Proceedings.
