Sub: Regularisation and absorption of Daily Wage/N.M.Rs./on consolidated pay - Implementation of A.P.A.T./High Court Orders - Issue of speaking orders - Certain instructions - Issued.

In the G.O. 2nd cited the Government have formulated a scheme for regularisation of services of the persons who worked continuously for a minimum period of 5 years and are containing as on 25-11-1993 by the appointing authorities subject to fulfilment of certain other conditions stipulated therein.
 
2.         Certain N.M.Rs./Daily wage workers who are not eligible for regularisation of their services in terms of G.O.Ms.No. 212, Fin. dated22-4-1994 are approaching A.P.A.T./High Court of Andhra Pradesh for regularisation of their services.
 
3.         The Hon'ble A.P.A.T./High Court of Andhra Pradesh have been disposing these cases with a direction to verify whether the applicant/petitioner satisfies the requirements laid down in Act 2/94 and G.O.Ms.No.212, Finance, dt. 22-4-1994 if the applicant satisfies the conditions of the said G.O. appropriate orders may be passed within a specific period.
 
4.         The appointing authorities are not taking action in time for considering the cases as per the judgements of A.P.A.T./High Court of Andhra Pradesh and are not issuing and appropriate speaking order with regard to regularisation or otherwise.
 
5.         As a result of such inaction individuals are approaching the Courts and filing contempt applications making the Government in Finance Department as 1st respondent causing an embarrassing situation.
 
6.         In view of the above circumstances, all the Departments of Secretariat and Heads of Departments and Managing Directors of State Government Undertakings and Corporations are requested to see that as and when the judgements are received from A.P.A.T./High Court in respect of N.M.Rs./Daily Wage Workers for consideration of regularisation of their services in terms of G.O.Ms.No. 212, Finance (PC.III) Department, dated 22-4-1994, speaking orders are issued duly examining the judgements within the prescribed period in terms of thy orders issued in the matter on the following lines:
 
i) If the petitioner / applicant is not eligible for regularisation, the claim may be rejected indicating clearly the grounds.

 

ii) If the petitioner / applicant is found eligible for such regularisation in terms or G.O.Ms.No.212, Finance: dated 22-4-1994 necessary appropriate order for regularisation.

 
7.         As an example, in this regard a copy or the latter of Government Pleader for Finance is enclosed for reference.
 
8.         The above instructions should be scrupulously followed so as to avoid contempt cases in the matter.
