ORDER:

In the G.O. first read above special Rules were issued for the 'post of Shroff working in various Departments. o Provision was made in the above Rules for application of rule of reservation for the post of Shroff. Based on the recommendation of one-Man Commission the existing different classes in the Andhra Pradesh General Subordinate Service Rules commonly applicable 10 the posts of Record Assistants, Lift operates, Shroff, including-Cashier, Drivers, and Motorcycle Messengers etc. were merged into one and reissued orders in G.O. second read above.

2. One Sri Y. Balagangadhar tilak has filed O.A.No.7073/93 in the Hon’ble Andhra Pradesh Administrative Tribunal for seeking direction to observe communal reservation under General Rule 22 for the post of Shroff. The Hon’ble Andhra Pradesh Administrative Tribunal in its judgement, dated 5-12-94, has held that the rule of reservation will have to be applied to the direct recruitment to the posts in Civil services in terms of rule 22 of the Andhra Pradesh State and Subordinate Service Rules.

3. The Government after careful examination of the matter keeping in view the above order of the Hon'ble Tribunal. have decided to issue suitable amendment to the Andhra Pradesh General Subordinate Service Rules issued in G.O.Ms.NO.965, G.A.(Ser.B) Dept., dated:21-10-95 incorporating Rule of reservation under General Rule 22 to the posts for direct recruitment. The following notification will be published in the Andhra Pradesh Gazette.

NOTIFICATION

In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and all other powers hereto enabling the Governor of Andhra Pradesh hereby makes the following amendment to the Andhra Pradesh General Subordinate Service Rules issued in G.O.Ms.No.965, G.A. (Ser.B) Dept., dated the 21^st October 1995.

AMENDMENT

In the said rules after Note (2) of rule 3 the following shall be added; namely

Note (3) "General Rule 22 of the Andhra Pradesh State and Subordinate Service Rules shall be followed in respect of Direct Recruitment to the posts included in these rules"
