ABSTRACT

Public Services - Adhoc rule to consider the Disabled persons (viz., Visually Handicapped, Orthopaedically Handicapped / Deaf & Dumb i.e., Hearing impaired) who prosecuted higher Studies directly without the qualification of Intermediate to the pass of Group IV services viz., Junior Assistant/ Typist/ Junior Stenographer / Junior Accountant etc. in Andhra Pradesh Ministerial Services in the Offices other than the Offices of the Heads of the Departments - Orders - Issued.

ORDER:

1.   According to Annexure-1 to rule 6(1) of the APMS Rules issued in the G.O. first read above, Intermediate is the basic qualification prescribed to the post of Junior Assistant/ Typist/ Junior Stenographer/ Junior Accountant etc., in the Offices other than the Heads of Departments and Directorates.

2.  The Commissioner, Disabled Welfare, Hyderabad in his letter second read above has reported that several Disabled persons have not been considered for the posts under Group IV services viz., Junior Assistant/ Typist/ Steno Typist/ Junior Accountant etc., in the District Subordinate Offices on the plea that they do not possess Intermediate Qualification as per the A.P. Ministerial Service Rules and that though they do not possess Intermediate qualification, most of them have passed Degree, or Post Graduate courses by appearing directly through distance education or Open Universities and thus are having higher qualifications. It has also been reported that a few candidates have represented for providing exemption from pass of Intermediate, so that they can be considered as qualified for the posts under Group IV services in the Subordinate Offices. He has further stated that the Visually Handicapped/ Orthopaedically Handicapped persons are staying in home and hostels run by the Department, and they are hailing from poor and illiterate families and after getting admission in the homes, they appear directly for Degree and afterwards Post Graduate courses through Distance Education and Open Universities without having the qualification of Intermediate. He has therefore requested the Govt. to permit the Physically Handicapped candidates (Disabled Persons) who are having Degree and / or Post Graduation qualification without having the qualification of Intermediate for the posts in Group IV services in the District Subordinate Offices without insisting for passing Intermediate.

3.   Government after careful examination have decided to consider the Disabled persons (viz., Visually Handicapped, Orthopaedically Handicapped / Deaf and Dumb i.e. Hearing impaired) who prosecuted higher Studies, such as Degree and or Post Graduate Qualifications, directly without the qualification of intermediate, for the posts of Group IV services viz., Junior Assistant / Typist / Junior Stenographer / Junior Accountant etc., in the Andhra Pradesh Ministerial services and in the other relevant services in the offices other than the Offices of the Heads of the Departments to which Intermediate is prescribed as the basic qualification, in the event of non-availability of Physically Handicapped candidates (Disabled Persons) with the basic educational qualifications prescribed for the said posts in the Andhra Pradesh Ministerial Service Rules and other relevant rules.

4.  Accordingly, the following notification will be published in the Andhra Pradesh Gazette immediately.

NOTIFICATION

In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India and all other powers hereunto enabling, the Governor of Andhra Pradesh hereby makes the following Ad-hoc Rule, namely:

AD-HOC RULE

“Notwithstanding anything contained in the A.P. Ministerial Service Rules and in other relevant rules, in the matter of Direct Recruitment to the posts of Group IV services viz., Junior Assistant / Typist / Junior Stenographer / Junior Accountant etc., in the Andhra Pradesh Ministerial services and other relevant services in the District Subordinate Offices i.e., the offices other than the Offices of the Heads of the Departments, for which Intermediate is prescribed as the basic qualification, the Physically Handicapped persons (Disabled Persons), who prosecuted higher Studies, such as Degree and or Post Graduate Qualifications, directly without the basic qualification of Intermediate prescribed in the said rules, may be considered for appointment to the said posts without insisting of the pass in Intermediate qualification, in the event of non-availability of eligible Physically Handicapped candidates (Disabled Persons) with the basic educational qualification prescribed for the said posts in the relevant Service Rules.”
