Public Services - Passing of Language test in Telugu as qualification for direct recruitment - Adhoc Rule - Issued.

ORDER:

Orders are being issued by the Government from time to time for the last several years proposing exemption from passing the Telugu Language test and the last such exemption was given by way of executive orders in G.O.Ms.No.124, General Administration (OL.I) Department, dated 1-4-98 providing exemption up to the end of June 1999. It was also observed that the Andhra Pradesh Public Service Commission suggested further extension of time up to the end of June 2001 for those employees who have not passed the language test in Telugu till the end of June 1999. Further the Andhra Pradesh Public Service Commission had also suggested that for all those persons who are appointed on or after 1-7-1999, a period of time of four years shall be given to them for passing the language test in Telugu and to discharge them from service, if they fail to do so.

The aforesaid orders are resulting in dilution of the policy laid down in the Andhra Pradesh Official Language Act, 1966 and the periodical extension of such exemption is creating an impression in the minds of the employees that the exemptions can be sought for any length of time and that they can get away without the knowledge of Telugu which is the official language of the State. It is observed that the very purpose of the Andhra Pradesh Official Language Act, 1966 and its implementation in the Government is being lost by such extensions.

3. In order to overcome the aforesaid difficulty and to have an effective implementation of Telugu as an Official Language and to obviate the necessity for either conducting of the Telugu Language test or for passing of such test it is decided to stipulate a pass in Telugu of Secondary School Certificate standard as a must and for any post for which the qualification is lower than the Secondary School Certificate a minimum of 50% marks in Telugu in the qualifying examination is required for all the recruitments to be made after 01-01-2003, so as to enable the candidates seeking Government employment to have adequate time of nearly 4 (four) years up to 1st January, 2003 to acquire the said requisite qualification in Telugu Language before joining Government employment.

Accordingly, the following adhoc rule is issued

The concerned administrative departments of the Secretariat are directed to take immediate steps for bringing an amendment to the Service Rules or to Special Rules incorporating the adhoc rule specified below wherever necessary.

The following notification will be published in the Andhra Pradesh Gazette.

NOTIFICATION

                In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and of all other powers hereunto enabling, the Governor of Andhra Pradesh hereby makes the following adhoc rule in respect of the public seeking employment after 1st January 2003 in the Government of Andhra Pradesh.

ADHOC RULE

Notwithstanding anything contained in the Andhra Pradesh State and Subordinate Service Rules, 1996, the Andhra Pradesh Ministerial Service Rules, 1998, the Andhra Pradesh General Subordinate Service Rules, 1995 and the Andhra Pradesh Last Grade Service Rules, 1992 as well as Andhra Pradesh Judicial Ministerial Service Rules, and Special rules of any service and in any rules for the time being in force, in the matter of direct recruitment to be made on or after 1st January, 2003, candidates should pass in Telugu Language of Secondary School Certificate standard, and in respect of the posts where the qualification prescribed is lower than the Secondary School Certificate, such candidates shall secure a minimum of 50% marks in Telugu Language in the qualifying examination.
