(SPF.A) Department in the refs. 1st and 2nd cited.
certain instructions have been issued in the reference 3rd cited
with a detailed example regarding filling up the posts by providing for reservation
in terms of local and open Competition category candidates for ensuring reservation
provided in Rule 22 of the A.P. State and Subordinate Service Rules. The
Commissioner and Director of School Education in his reference 4th cited
while stating that the example case enclosed to the memo 3rd cited
has created certain difficulties to the recruiting agencies and sought
clarification on the following.
i)
How to calculate reservation infavour of local and non-local candidates when there
are C.F. vacancies vis-a-vis various communities (Rule of reservation);
ii)
Where SC (A) candidates are not available, whether the posts reserved for S.C.
(A) candidates can be filled up with S.C. (B), S.C. (C) or S.C. (D) candidates.
iii) What is the order (sequence in which various categories like OC (G), OC (W). BC (G), BC (W) etc., to be followed in filling up vacancies.
2. In the circumstances, while cancelling the instructions
issued in the Memo. 3rd cited; the following clarification is given
in respect of the 3 points mentioned above.
i)
With regard to the 1st point, it may be stated that as per the
orders issued in the G.O. 1st cited read with the provisions of Andhra Pradesh
Public Employment (Organisation of Local Cadres and Regulation of Direct
Recruitment) Order. 1975 i.e. Presidential Order, while filling-up of the posts
which are organized as district cadre posts, 20% of the posts shall be filled
up first from the combined merit list of both local and non-local candidates by
following the special representation provided in Rule 22 of A.P. State andSubordinate Service Rules and thereafter the remaining 80% of the posts shall
be filled up by local candidates only by following the special representation
provided in Rule 22 of the A.P. State and Subordinate Service Rules. Thus,
there is a reservation on two counts one communal reservation for the first 20%
of the posts and another in local candidate reservation. Since reservation in favour
of Schedules Castes. Scheduled Tribes, Backward Classes. etc. is Constitutional
guarantee. it follows that if there are any unfilled vacancies in respect of
Schedules Castes, Scheduled Tribes etc., from out of the first 20% of posts and
also in the remaining 80%, of posts Such un-filled vacancies in Schedules
Castes, Scheduled Tribes etc. have to be invariably carried forward for being
filled in the next recruitment separately in terms of rule 22 of the A.P. Stateand subordinate Service Rules. If the carried forward vacancies are from the
first 20%, of the previous list, they are open for both local and non-local but
subject to the communal reservation. If the carry forward vacancies are from
the 80% list i.e., list of local candidates, the posts have to be filled up by
local candidates subject to the communal reservation.
ii) With regard to the 2nd point, attention is invited to the Note under Rule 5 of the A.P. Scheduled Castes (Rationalisation of the Reservations) Rules' 2000 issued in G.O.Ms.No.47 Social Welfare (CV.I) Department dated31.05.2000 wherein it is stated that if an eligible candidate for public appointment is not available from Scheduled Castes-A, the roster point may be filled up by a candidate of Scheduled Castes B and so on and so forth. In the case of women candidates also in the roster point fixed for Scheduled Castes - A (Woman). if an eligible woman candidate is not available, the roster point may be filled by a woman candidate belonging to the Scheduled Castes-B and so on and so forth. Further roster point No. 14 (i.e.) Backward Class (Group-C) (Women), this point is to be filled by women candidate in 3rd cycle of 100 points. iii) With regard to third point, it is clarified that the order to be followed in filling up the vacancies is as per the order of the roaster points specified in sub-rule 2 (e) of Rule 22 of the A.P. State and Subordinate Service Rules.
3. The Education Department are advised to issue suitable
instructions to the Commissioner and Director of School Education, Hyderabad.
