2. Aggrieved by this, certain candidates have approached the AP.
Administrative Tribunal seeking directions to follow social reservations in the
first 20% of the vacancies also. The Honourable A.P.A.T. in its judgement 3rd
read above, has directed as follows:
"The rule of reservation is to be applied for the open category. The rule of reservation shall be applied from the point at which it ended during the last selection process, in each district. In the facts and circumstances present herein, the respondents are directed to re-cast the selection list, by reviewing the same, keeping in view the above directions, and this exercise shall be completed before the issuance of appointment orders to the candidates selected in DSC-2002. It is further directed that such of those persons who are now selected by way of the review of the selection list, shall be given appointment orders before the appointment orders are issued to the candidates selected in DSC-2002. However, we do observe that it is left open to Government to take such action it deems fit in the interests of justice to consider the cases of these candidates who were selected and appointed and who are likely to lose their appointments on account of the implementation of the directions given herein".
3. Government in the Memo 4th read above, have issued instructions on the correct way of filling-up of direct recruitment posts, localized under Presidential Order / Communal Representation under Rule 22 of A.P. State and Subordinate Service Rules.
4. Government have examined the matter, with reference to the reports submitted by the Commissioner & Director of School Education, Hyderabad, in his letters 5th & 6th read above, and after careful consideration hereby direct that the candidates who are likely to lose their appointments due to implementation of Honourable A.P.A.T. orders as per the directions given in Government Memo, 4th read above shall be adjusted against the available vacancies.
5. The Commissioner & Director of School Education, A.P. Hyderabad, shall take action accordingly.
