Regulation 16 (1) of A.P. Public Service Commission
Regulations, 1963, read as follows:
"Shall not be
necessary to consult the Commission regarding the appointment of a person
temporarily for total period not exceeding three months in the case of each
individual to a post borne on the cadre of a service to which appointment has
to be made after consulting the Commission.
(i) Where it is necessary in the public interest owing to an emergency which has arisen to fill immediately a vacancy in the post and there would be undue delay in making the appointment after such consultation."
2. In the reference cited, the Secretary, A.P. Public Service Commission has brought to the notice of Government that ad-hoc appointments involving promotion/ transfer to next higher categories are made to fill up vacant posts which are under the purview of A.P. Public Service Commission for unduly long periods in contravention of the above Regulation 16 (1) of A.P. Public Service Commission Regulations, 1963. This resulting delay in preparation of regular panels for various categories of posts in State Service. The administrative delay and also the lapse in preparing the regular panels is the root point for the litigation in Court of Law.
3. Keeping the above in view, it is reiterated that the list of approved candidates for promotion/ appointment by transfer to next higher categories shall be prepared in accordance with Rule 6 in A.P State and Subordinate Service Rules. Wherever, it is considered necessary in the exigencies of administration, the ad-hoc appointment shall be made as per Regulation 16 (1) of A.P. Public Service Commission Regulations, 1963.
4. The Departments of Secretariat and Heads of Departments are
requested to follow the instructions scrupulously.
