Instances have come to the notice of Government where the pay of employees holding Special Grade posts when Promoted to the next promotional posts under the Service Rules applicable to the posts which carrying the same scale as those of special Grade Posts is not fixed under the provisions of F.R.22 (a) (i). Government have clarified in Memo 2nd cited, that when employees holding special promotion posts are promoted to next promotional posts under the service rules applicable to the posts carrying the same scale of pay as those of special promotion posts, they are eligible for fixation of their pay in the scale applicable to the regular promotion posts under F.R. 22 (a) (i) based on the pay drawn in special promotion posts provided the conditions laid down in that rule are satisfied. The same principle should apply for fixation of pay of an employee who is promoted while holding the Special Grade Post, to a regular promotion post, under the service rules, carrying the same scale of pay as the special grade post. Government therefore hereby clarify that when employees holding special grade posts are promoted to the next promotional posts under the service Rules applicable to the posts and where such promotional posts carry the same scale as the special grade posts, the pay of such promotees should be fixed, under F.R. 22 (a) (i) based on the pay drawn by them in the special grade posts immediately prior to promotion.
All the Heads of Departments are requested to bring the above clarification to the notice of their subordinate offices for their information and guidance.
