ABSTRACT

Creation of special grade posts for employees who have completed 10 years and special promotion post / special adhoc promotion post for employees who have completed 15 years of service-Regulation of pay on promotion to the higher post in regular line by treating the pay down in the special grade/ special promotion post / special adhoc promotion post as substantive pay.

O R D E R:

According to clarificatory orders issued against item 9 of the Memorandum No.41086-B/202/PRC.l/81, dated 31-12-1981, the next increment to the appointed to special Grade Post/Special Promotion Post/Special Adhoc Promotion Post on 1st April 1981 will accrue on the date on which an increment would have accrued had be continued in the old scale of pay. In the Memorandum No.26378/C/660/PRC.I/82, dated 24th June 1982 Government have clarified that when employees holding special Promotion posts are promoted to the next promotional posts under the service Rules applicable to the posts, they are eligible for fixation of their pay in the scale applicable to the regular promotion post under F.R.22(a) (i) provided the conditions laid down in these rules are satisfied.

2.         The Pay and Accounts Officer in his letter No. PAO/Admn.II/ U.1/82-83/394, dated 15th September, 1982, has stated that it is not clear whether this protection of normal date of increment can be extended to persons who are promoted to the next higher post after being considered for appointment to the Special Promotion Post Scale, as the Government have not declared the pay in the special Promotion Post as substantive pay for any purpose excepting to fix the pay of such officer on his promotion to a vacancy in the (Regular) higher post. He has therefore requested to clarify the position.

3.         Government have examined the issue. In view of the clarificatory orders issued in Memorandum 3rd No.26378/C/660/prc.I/82, dated 24th June, 1982, the original d.1te of increment is not protected on promotion to a higher post in the regular line while holding special Grade / Special Promotion Post/Special Adhoc Promotion post. Government hereby clarify that since Mayemployees even after appointment to the Special Grade Post/Special Promotion Post / Special Adhoc Promotion post continue to discharge the same functions which they were performing prior to their appointment to Special Grade Post/Special Promotion Post / Special Adhoc Promotion Post in pursuance of the orders issued in G.O.Ms.No.266, General Administration (Services) dated 25th May, 1981, the pay drawn by such employees in the Special Grade/Special Promotion Post/Special Adhoc Promotion Post shall be treated as substantive pay for purposes of regulation of their pay in the higher promotion post in the regular line.

4.         All the Departments of Secretariat and Heads of Departments are requested to bring the above order to the notice of appointing authorities concerned.
