ORDER:

In the Order Sixth read above, while according, permission to the District Selection Committees to take up limited recruitment as well as general recruitment to the posts in Group-IV Services in the District Subordinate Offices under its purview, it has also been directed to adopt and follow the same scheme, guidelines, procedure, and instructions as envisaged in the G.Os. 1st to 4th read above, for recruitment.

2. Among other things, in paras 6, 10(a), 15 and 16 of the general guidelines and scheme for the recruitment of Group-IV Services appended to the G.O. first read above. it has been directed as follows, respectively:-


(6) "Candidates who have studied intermediate, S.S.C through the Telugu medium shall be given weightage in the matter of 􀄇election by awarding 5% of the total marks prescribed subject to the outcome of the case pending before the Supreme Court."

 

10 (a)" After the Written examination, candidates equivalent to three times the number of vacancies notified for each category (Scheduled Caste, Scheduled Tribe, Backward Class and Open Competition) according to order of merit, will be called for interview. Preference available for women should also be kept in view vide General Rule 22-A"

 

 (15) "30% of the posts in each category of Open Competition, Backward Class, Scheduled Caste and Scheduled Tribe quota arc to be reserved io be filled by women in the respective categories."

 

 (16)  “Based on the merit list, a final list for appointment shall be prepared following the rule of reservation (General Rule.22) Preference for women General Rural (22A) and the Presidential Order, 1975 in local cadres, wherever necessary, confined to actual number of vacancies.  However, to meet contingency on account of not joining by selected candidates, candidates in the merit list up to 10% shall be kept in reserve.  The waiting list should not be operated after substitutes are given in place or persons who do not report for duty."

3. The Supreme Court or India in its judgement dt.25-1-1995 in Civil Appeal No.291-1/1981 with Civil Appeal No.102 2 and 1023 of 1995 (Special Leave Petition (C) No.6395 and 13446 of 1994) have held that 5%  weightage given to the Telugu medium graduates, is violative of Article 14 and 16(1) or the Constitution of India and therefore set aside the judgement and order dt.15-09-1981 of the Division Bench of the High Court of Andhra Pradesh in W.P.No:391/1981 duly restoring the order dt 17-6-1981 or the Single Judge of High Court of Andhra Pradesh in W.P.No.2041/1981, subject to certain observations in the judgement.

4.  In the G.O. 5th read above, orders were issued amending, sub-rule (2) or Rule 22-A of the Andhra Pradesh State and Subordinate Services Rules i.e., reserving the 30% of the post, for women in each category or Open Competition, Backward Class-A, Backward Class-B, Backward Class-C, Back ward class – D, Scheduled Caste, Scheduled Tribe and physically handicapped and Ex-Servicemen Quite in the matter of direct recruitment Lo the posts for which men and women are equally suited. Provided that if sufficient number of women candidates are not available the vacancies shall be filled in by men.

5. In view or the Judgement of the Supreme Court referred to at para 3 ante and also consequent to the orders issued in the G.O. fifth read above, the following amendments arc issued to para (6), para 10(a), para (15) and Para (16) or the general guidelines and scheme for the recruitment of Group-IV Services approved with G.O.Ms.No.401, General Administration (Ser.A) Department. dt. 16-8-1994:-


AMENDMENTS

(a) In the general guidelines and scheme approved with the said G.O. Para 6 shall be omitted.

 

(b) For sub-paragraph (a) or para to the following sub-para shall be substituted. namely:

 

“10 (a) After the written examination, candidates equivalent to three times the number of vacancies notified for each category (S.C., S.T., B.C-A. B.C-B. 8.C.-C, B.C.-O, Open competition and physically Handicapped etc.,) according to order of merit, will be called for interview. Reservation available for women should also be kept in view vide General Rule 22-A":

 

(c) in paragraph 15 for the expression. "O.C. B.C., S.C., and S.T." the expression "O.C., B.C-A, B.C-B, B.C-C, B.C-D, S.C., S.T, and Physically Handicapped etc., shall be substituted; and

 

(d) in paragraph 16 for the word "preference" the word. "reservation" shall be substituted.
