In the case of K. Venkata Raju Vs. Government of Andhra Pradesh, 1999 (4) ALD 291, the Division Bench of the High Court of Andhra Pradesh held that the Andhra Pradesh Civil Services (Classification, Control and Appeal Rules) in the Endowments Department as it is not one of the subordinate services included in Schedule II of the said rules prior to the orders issued by the Government in G.O.Ms.No. 213, Revenue Department dated 8-6-98 on the ground that the said rules cannot be made applicable to the Executive Officers of Endowments Department as they were included in Schedule II only with effect from 08-06-98. Consequently, the Andhra Pradesh Civil Services (Classification, Control and Appeal) Rules, 199 l did not apply to the Executive Officers of the Endowments Department prior to issue of G.O.Ms.No.213, Revenue Department dated 8-6-98. To overcome the aforesaid difficulty, Government have decided to amend rules 6 and 7 of the Andhra Pradesh Civil Services (Classification, Control and Appeal) Rules, 1991 suitably.
The following Notification will be published in the Andhra Pradesh Gazette:
NOTIFICATION
(a) for rule 6, the following shall be substituted,
namely: -
"6. The State Services shall consist of
the services specified in Schedule I to these rules and includes any other
services that may be notified or as the case may be constituted by Government
from time to time".
(b) for rule 7, the following shall be
substituted, namely: -
"7. The Subordinate Services shall consist of the services specified in Schedule II to these rules and include any other services that may be notified or as the case may be constituted by Government from time to time.”
