ORDER:

The Commissioner, Disabled Welfare, Hyderabad in the letter 2nd read above, has informed that the Association of Maruguchi (Dwarfs), Hyderabad has submitted a representation to the hon’ble Chief minister that Dwarfs should be recognized as Disabled persons for the purpose of availing benefits extended by Government. Toe C.M's Office forwarded the application to the Commissioner, disabled Welfare to take action in the matter. The Commissioner, Disabled Welfare referred the matter to the Director of Medical Education, Hyderabad to furnish his remarks in this regard. Accordingly, the Director of Medical Education instructed the Superintendent, Osmania Hospital to examine the issue and submit his report in the matter. The Commissioner, Disabled Welfare further informed (vide letter 4th read above) that the Superintendent, Osmania General Hospital, Hyderabad vide his letter 3rd read above has furnished his report, which reads as follows:-

"As regards Dwarf persons, their inclusion in the category of Orthopaedically handicapped persons is decided by Permanent Disability, and Physical impairment, disability is described as when a person's actual or presumed ability to engage in gainful activity is reduced or absent because of a medical condition related to anatomical or functional abnormality. The state of being disabled is also defined as absence of competent physical, intellectual and moral power.

In view of the above, a Dwarf person can be included as handicapped or disabled because of loss of physical intellectual and moral power as a result of short structure and abnormal (stunted) bone and joint 1.1rowth. As a result of short structure and abnormally retanled bones and joints, the ability of dwarfs to engage in gainful activity is considerably reduced. Hence dwarfs are eligible to be included in the category of Orthopaedically handicapped".

2. Government of India have also defined and issued the following guidelines for evaluation of Permanent Physical Impairment in cases of short stature/dwarlism:

 

1) Recumbent length or longitudinal height below 3rd percentile or less than 2 Standard Deviation from the mean is considered as short stature. 919

 

2) The evaluation of a Short statured person should be considered only when it is of disproportionate variety and is accompanied by underlying pathological conditions e.g., Achondroplasia, Chandrodysplasia Punctata, Spondy-loepiphysical dysplasia, Mucopoly and acchrydosis, etc.

 

3) The ICMR norms (enclosed as Annexure) should be used as guidelines for height.

 

4) Every “l” vertical height reduction should be valued as 4% permanent physical impairment.

 

5) Associated skeletal deformities should be evaluated separately and total percentage of both should be added by combining them formula.

3. The Commissioner, Disabled Welfare has therefore requested the Government to issue necessary orders as per the guidelines prescribed for issuing disability certificate to Dwarf persons by the Government of India and for inclusion of the category of Dwarf persons in the category of Orthopaedically handicapped (locomotor disability) so that the Chairmen of the District Medical Boards which were constituted vide G.O. 1st read above can be addressed to issue Medical Certificates to the Dwarf persons to get Government benefits on par with other categories of the disabled.

4. Dwarfs who are treated as Orthopaedically Handicapped are eligible to get benefits like Bus passes, Rail Concessions, Disabled pensions, Scholarships, Marriage Incentive Awards, Fair price shops, Housing, Reservations in Employment, Financial Assistance, etc. as per the orders/ rules in force.

5. After careful examination, the Government hereby order that Dwarf persons be included in the category of Orthopaedically Handicapped. 6. The Commissioner, Disabled Welfare is requested to take necessary action in the matter.
