This has been
laid down in G.O.Ms.No. 36, G.A.D., dt. 25.1.90 which states the credit will be
given for the service rendered by them in their parent department for regulating
their pensions. Though they are treated as fresh employees for the purpose of
seniority in the department to which they stand allotted, past service from the
date of regularisation will be taken into account for pension purpose.
As per the orders issued in the G.O.Ms. No. 36, GAD, dated 25-1.90, the rule of reservation for SCs/STs has to be followed. The recruitment should be considered as direct. Wherever it is not possible to accommodating the surplus candidates on the available roaster, they have to be adjusted against the future arising vacancies.
In Govt. Memo
No. 220/Ser.A/91, GAD, dt. 20.2.91, it was stated that the new rules / qualifications
need not be insisted upon at the time of their absorption in other departments
since they are Govt. employees recruited already as per the then existing rules.
Hence specific qualifications in respective posts need not be insisted upon.
As per the
orders issued in G.O.Ms.No. 36, GAD, dt. 25.1.90, the pay last drawn by the
surplus staff before their allotment, will be protected. Hence the pay last
drawn by the surplus personnel should be protected in the Government
departments as per the LPC.
There may be
difference of pay and pay scale between the department where the surplus person
was working and the departments to which he allotted. If the person, who is
drawing less pay/ pay scale in the parent department and if he is allotted to
the post which carries higher pay scale, he can be given the higher scale as he
is treated, as direct recruitment person. If the scale is lower, the pay has to
be protected as clarified above.
The individual allotted to the Government departments, be given the annual grade increments on the usual pay on which he would have drawn the increment if he had continued in his parent department.
After
allotment of the candidates, the revision of pay scales and its benefit on the
allottee department will be applied, as they are part and parcel of the
department to which they are allotted.
As their past
service is counted and last pay drawn is protected, it is but natural to count
the previous service rendered for giving the benefit of automatic advance increment
also.
Surplus
personnel available in the pool being allotted carry different nomenclature in
different departments. However, while making allotments, their educational
qualification and suitability to do similar job is considered before allotment. Hence Government departments need not insists
allotment of particular category of surplus personal for a particular category
of post. At times some minimum inductional training could be required which
need to be provided at Government expenses.
The allotment
of candidates from SMPC is for initial direct recruitment post in the department.
After allotment the individual will become full member of that department. Hence promotion to such personnel should be
in accordance with the existing rules of the allotted department in future.
Counting his seniority in the initial post for which he was allotted from the
date of his joining in the allotted department.
The relaxation of qualifications being only at the time of first allotment, all subsequent promotion posts to be held will be guided by the qualification rule of the department.
As per the orders issued in the G.O.Ms.No.36, GAD, dt. 25.1.90, where it is not possible to make reallotments to absorb within the local cadres, the provisions of the presidential order can be invoked. As per the presidential order, Government employees can be posted across zones in public interest. As the availability of surplus people in one zone without meaningful job or where they cannot be absorbed is a drain on public exchequer, it serves public interest to make use of their service elsewhere in a different zone where there is a need of such personnel. Hence, the surplus personnel available in one place can be allotted to any other place in a different zone where vacancies are available in the public interest.
