U.O.Note.No:11107/Ser.C/99 Dated:01-03-1999
Sub: Public Services -
Disciplinary cases - Procedure to be followed on receipt of the Enquiry Report
- Instructions - Issued.
Rule 21 of Andhra Pradesh Civil Services (Classification, Control and Appeal) Rules, 199I lays down the procedure, on further action to be taken on receipt of the report of the Enquiry Officer. The Disciplinary authorities shall take an independent view based on the findings in the Enquiry Report with reference to the record after due consultation with Andhra Pradesh Vigilance Commission/APPSC wherever such consultation is necessary.
2. It has been brought to the notice of the Government that certain departments of Secretariat are obtaining the remarks of the Heads of Departments on the report of the Enquiry Officer which is not contemplated in the Andhra Pradesh Civil Services (Classification, Control and Appeal) Rules, 1991. This practice is also delaying the issue of final orders on the disciplinary case. As per rules, the departments as a disciplinary authority have to examine the findings of the Enquiry Officer independently and come to its own conclusion.
3. It is also brought to the notice that some departments are referring the report of Enquiry Officer to the Director General, Anti-Corruption Bureau for remarks which is also not provided for in the Andhra Pradesh Civil Services (classification, Control and Appeal) Rules, 1991 and therefore such action is not in order.
4. All the Departments of Secretariat are requested to ensure that in all disciplinary cases, final decision on the enquiry report shall be taken by the concerned Disciplinary authority alone and in consultation with the Andhra Pradesh Vigilance Commission / Andhra Pradesh Public Service Commission, wherever it is necessary as per rules and they shall not seek the views / remarks of the Heads of Departments on the report of enquiry Officer. However, after issue of final orders on enquiry report such order shall be communicated to the Delinquent Officers through the Heads of Departments under intimation to the Director General, Anti-Corruption Bureau, Hyderabad.
5.
The receipt of this U.O.Note shall be acknowledged.
