ORDER:

The issue of applicability of the Six Point Formula to the Workcharged Employees has been engaging the attention of the Government for some time past.

2.  Under para 3 of the A.P. Public Employment (Organisation of Local Cadres and Regulation of Direct Recruitment) Order, 1975, the State Government shall within a period of 18 months from the commencement or the order, organised classes of posts in the Civil Services of, and Class of Civil Posts under the State into different local cadres for different posts of the State to the extent and the manner provided therein. The proviso to the Sub-para also provides that notwithstanding expiration of the said period, the President, may, by order, require the State Government, whenever he considers it is expedient so to do, to organise any class of posts in the Civil Services of, and Classes of Civil Posts under the State into different Local cadres for different parts of the state. Sub para (2) of para (3) of the said order also provides that the Posts belonging to the Category of Junior Assistants, and to each of other categories equivalent to or Lower than that of Junior Assistants in each Department, in each District shall be organised into a separate Cadre.

3.  Since the Workcharged Establishment does not have direct recruitment pattern, it has not been organised into a separate cadre. As and when need arises N.M.R. Workers will be taken as per the work that is to be charged. A Workcharged employee though by virtue of his provincialisation is being considered as a Government Servant, the post which the individual holds would be ceased as and when he retires from the Service. In as much as the Workcharged Staff employed on heavy machines may have to move with the machines as there may be practical difficulties in not carrying the men and the machines together. Thus, the Workcharged Establishment itself stands on a different footing.

4. The issue of applicability or the presidential Order or Six Point Formula in relation to the Workcharged Establishment has been examined by the Government in a greater detail and it is decided to exempt the Workcharged Establishment from falling under the Six Point Formula and accordingly Government hereby exempt the Workcharged Establishment duly relaxing. Para (2) (c) of the G.O. fourth read above and direct the Engineer-in-Chief, (I.W.) to follow the earlier instructions issued in the Government Memo 1st read above, by forming a Central Pool of Surplus workcharged Employees and N.M. Rs in his Office for allotting them to the needy Units.
