ORDER:

In the order first read above, instructions were issued regarding the method of pay fixation of Government servants on their promotion to a higher post. To give effect to this decision, the Fundamental Rules and the Hyderabad Civil Service Rules were amended inserting therein the new rules 22-B and 35-A respectively.

2. In the order second read above, the provisions of the new rules were given effect to, from the 25th December 1982 with monetary benefit from the 23rd August, 1983.

3. Through the representation third read above the Andhra Pradesh Secretariat Association has brought to the notice of Government among other things, that the seniors promoted to a higher post before 25th December 1982 (date of introduction of the new rule), would draw less pay than those promoted after that date and who got the benefit of fixation of pay under the new rule.

4. Government have examined the matter carefully in the light of the orders issued by Government of India to safeguard the interests of a senior promoted before the introduction of the new rule, in relation to a junior promoted after the new rule came into existence. After careful consideration Government have decided that in such cases, the pay of senior person, promoted to the higher post before the 25th December, 1982, should be stepped up to a figure equal to the pay as fixed for the junior in that higher post, as a result of application of the new rule. This will, however be subject to the following conditions viz.,


i) The stepping-up should be done, with effect from the date of promotion, or fixation of pay of junior official under the new rule 22-B of Fundamental Rules / Rule 35-A of Hyderabad Civil Service Rules.

 

ii) Both the Junior and Senior Officer should belong to the same cadre and the posts to which they are promoted should be identical and in the same cadre.

 

iii) The scale of pay of the lower and the higher posts in which they are entitled to drew pay should be identical.

 

iv) The anomaly should be directly as a result of fixation of pay of the junior person under the new rule consequent on his promotion after the 25th December 1982. For example, if even in the former post, the junior person draws from time to time a higher rate of pay under normal rules, or any advance increments are granted to him, the pay of the senior person promoted before the 25th December 1982 should not be stepped-up.

 

v) The orders refixi.ng the pay of the senior person, shall be issued under FR 27/Rule 41 of Hyderabad Civil Service Rules.

 

vi) The next increment of the senior person will be drawn from the date on which it would have fallen due but for the stepping-up of his pay under this order.

 

vii) In respect of pay fixations under this order, falling after 25th December 1982 but before 23rd August, 1983 the monetary benefit shall be allowed from 23rd August, 1983.

5. Action may be taken accordingly.
