1. List of documents produced by Presenting Officer

Ex-01: The Inquiry Officer encloses the 15 prosecution documents marked as PE-1 to PE-15, properly indexed, paginated, and signed on each page.

 

Ex-02: A separate folder containing all prosecution exhibits with an index sheet listing document number, description, date, and the date it was taken on record.

 

Ex-03: The Presenting Officer’s application for additional documents and the IA’s order allowing/refusing them are also enclosed in this section.

 

2. List of documents produced by Government Servant

Ex-01: The 5 defence documents marked as DE-1 to DE-5 are enclosed with proper index and cross-references to the evidence they support.

 

Ex-02: A folder containing the Charged Officer’s additional documents, medical certificates, affidavits, and other supporting material.

 

Ex-03: The Defence Assistant's list of documents submitted during the inquiry, with copies of all documents admitted by the IA.

 

3. List of prosecution witnesses

Ex-01: A separate list showing PW-1 to PW-8, their designations, dates of examination, and brief description of their depositions.

 

Ex-02: Full depositions of all 8 prosecution witnesses in chronological order, with each page signed by the witness and the IA.

 

Ex-03: Summary chart of prosecution witnesses showing key points of testimony relevant to each charge.

 

4. List of defence witnesses

Ex-01: A list showing DW-1 to DW-5, their designations, dates of examination, and brief description of their depositions.

 

Ex-02: Full depositions of all 5 defence witnesses in chronological order, with signatures of witnesses and IA.

 

Ex-03: Summary chart of defence witnesses showing key points of testimony relevant to each charge.

 

5. Deposition of witnesses in order

Ex-01: The complete depositions of PW-1 (Examination-in-chief, Cross-examination, Re-examination) in chronological order, with numbered questions and answers.

 

Ex-02: All depositions bound in one volume, starting with prosecution witnesses (PW-1 to PW-8) followed by defence witnesses (DW-1 to DW-5).

 

Ex-03: Each deposition has a certificate: "Read over and explained to the witness and admitted by him/her" with the witness's signature.

 

6. Written statement of defence

Ex-01: The Charged Officer’s initial written statement under Rule 20(4), the supplementary statement, and the response to the mandatory question.

 

Ex-02: A copy of the Charged Officer’s written brief submitted after the PO’s brief was supplied, with index and cross-references.

 

Ex-03: The Defence Assistant’s notes and submissions, if any, that formed part of the Charged Officer’s defence.

 

7. Applications and orders passed on them

Ex-01: The IA’s order dated 25.06.2023 allowing inspection of documents; order dated 01.07.2023 rejecting request for irrelevant documents; and the final order directing submission of briefs.

 

Ex-02: All oral requests made during the hearing and the IA’s rulings are recorded in the DOS and enclosed separately.

 

Ex-03: A separate section containing applications for adjournment, change of Defence Assistant, and the IA’s orders on each, with reasons.
