NOTIFICATION
In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and of all other powers hereunto enabling, and in supersession of Special Adhoc Rules issued in G.O.Ms.No.289, G.A (SC.D) Dept., dated 17.04.1980, G.O.Rt.No.2925, G.A(SC.D) Dept., dated  18.07.1986, G.O.Rt.No.2926, G.A (SC.D) Dept.,  dated  18.07.1986,  G.O.Rt.No.2927,  G.A(SC.D)  Dept.,  dated 18.07.1986, G.O.Rt.No.2928, G.A (SC.D) Dept., dated 18.07.1986 the Governor of Andhra Pradesh hereby make the following Special Rules for the Andhra Pradesh Anti-Corruption Service.
SPECIAL RULES

1. Short title and commencement:

These rules may be called the Andhra Pradesh Anti-Corruption Service Rules, 1991.

2. Constitution:

The Service shall consist of the following classes and categories of the posts in the Andhra Pradesh Anti-Corruption Service.

CLASS – A:

Category 1: Joint Director / Deputy Director (Forests)
Category 2: Deputy Director (Administration)
Category 3: Deputy Director (Revenue)
Category 4: Deputy Director (Engineering)
Category 5: Deputy Director / Assistant Director (Commercial Taxes)
Category 6: Deputy Superintendent of Police
Category 7: Deputy Executive Engineer / Assistant Executive Engineer
Category 8: Inspector
CLASS – B:

Category 1: Chief Legal Advisor

Category 2: Additional Chief Legal Advisor

Category 3: Legal Advisor cum Special Public Prosecutor including Government Counsel and Additional Government Counsel.
CLASS – C:
Category 1: Deputy Director (Accounts) (earlier designated to Accounts Officer / Chartered Accountant)
Category 2: Administrative Officer (Special Branch)
Category 3 (a): Assistant Director (Administration) (earlier designated as Personal Assistant to Director General of Anti-Corruption Bureau.
Category 2 & 3 renumbered as Category 3(a) & 3(b) and Category 2 inserted by G.O.Rt.No.5314, G.A.D. (Ser.-C), Dt.13-11-95, w.e.f. 19-1-94
Category 3(b): Managers (SB)
Category 4: Computer Programmer (earlier designated as Console Operator)

3. Method of appointment and appointing authority:

Subject to the other provisions in these rules the method of appointment and appointing authority shall be as noted in column (2) and (3) against each of class of category in column (1) of the table below:

1.      Joint    Director / Deputy Director (Forests)

By transfer/ on tenure of Deputy conservator of Forests form the Forest Department.

Note: If the post is held by a Deputy conservator of Forests of the IFS orders, he will be designated as joint Director and if he is from the State Service cadre he will be designated as Deputy Director.


2. Deputy Director (Administration)

By transfer/ on tenure of an Additional Superintendent of Police of Police Department

Government

3. Deputy Director (Revenue)

By transfer/ on tenure of Special Grade Deputy Collector of Revenue Department

Government

4. Deputy Director (Engineering)

By transfer/ on tenure of an Executive Engineer of R&B Department or Irrigation Department

Government

5. Deputy Director/Assistant Director (Commercial Taxes)

By transfer/ on tenure of an Assistant Commissioner (Commercial Taxes) or commercial Tax Officer of Commercial Taxes Department

Note: The post will be designated as Deputy Director if it is held by an Assistant Commissioner (Commercial Taxes) and as Assistant Director if it is held by a Commercial Tax Officer.

6. Deputy Superintendent

of Police

By transfer / on tenure of a Deputy Superintendent         of         Police, of Police Department.

7. Deputy Executive Engineer/Assistant Executive Engineer

By transfer/ on tenure of a Deputy Executive Engineer or Assistant executive Engineer of R&B or Irrigation department

1. Chief Legal Advisor

i) By promotion of Additional Chief legal Advisor 

ii) If no suitable or qualified Additional Chief Legal advisor is available for promotion by transfer on tenure of a District and Sessions Judge, Grade.II of Judicial Department or by deputation of an Officer of comparable rank in a similar organisation in the Government of India.

2. Additional Chief Legal Advisor

i) By promotion of Legal Advisor- cum-Special Public Prosecutor including Government Counsel and Additional Government Counsel. 

ii) If no suitable or qualified Legal Advisor-cum-Special Public Prosecutor including Government Counsel or Additional Government Counsel is available for promotion by transfer on tenure of an Officer of the rank of Sub-Judge from the Judicial Department or by deputation of an Officer of comparable rank in a similar organisation in the Government of India.

3. Legal Advisor cum Special Public Prosecutor including Government Counsel and Additional Government Counsel.

i) By appointment by transfer of a District Munsiff of the Judicial department or Assistant Public Prosecutor Grade.I or Police Prosecuting Officer by transfer on tenure of a District Munsiff of the Judicial Department or Assistant Public Prosecutor, Grade.I or Police Prosecuting Officer.

Government

CLASS – C:

 

 

1.      Deputy Director (Accounts) (earlier designated         to Accounts Officer / Chartered Accountant)

i) By transfer on tenure of Chartered Accountant / Cost Accountants working in any State Government Department in a comparable post. OR 

ii) By deputation on tenure of Income Tax Officers of Government of India or Officers of comparable rank in a similar organisation in the government of India. OR

 iii) By appointment on contract.

2. Assistant Director (Administration) (earlier designated as Personal Assistant to Director General of Anti-Corruption Bureau)

i) By appointment by transfer of Superintendent of the Andhra Pradesh Ministries Services of Anti-Corruption Bureau.

ii) If no suitable or qualified Superintendents are available by transfer on tenure of Gazetted Personal Assistants in the Police Department.

3. Managers (SB)

i) By appointment by transfer of Special Branch Assistants in the Anti-Corruption Bureau.

 

ii) If no suitable or qualified person in the category of S,B.Assistant is available by transfer on tenure of Managers int eh Intelligence Bran of Andhra Pradesh State Public Department.

4. Computer Programmer (Earlier designated as console operator)

By deputation from A.P. Technological Service Ltd., on lease – in basis.

4. Period of tenure:

The appointment on tenure to any post in the service shall not ordinarily be for more than 5 years at a time.

Provided that if any Officer who is promoted on out of turn seniority basis in the parent department, the total tenure shall not exceed three years.

Provided further that nothing in this rule shall preclude the Government or the Director General of Anti-Corruption Bureau, as the case may be, to repatriate the Officers taken on tenure to their parent department before expiry of the specified period of tenure, if it is considered necessary in public interest.

5. Qualification:

No person shall be eligible for appointment to the category specified in column (1) of the table under rule 11 of these rules by the method specified in column (2), unless he possesses the qualifications specified in the corresponding entry in column (3) thereof.

Every person appointed to any of the posts either by promotion or by transfer (not by transfer on tenure) shall from the date on which he commences probation be on probation for a total period of one year on duty within a continuous period of two years.

By direct recruitment by transfer or by deputation

Must have passed the chartered Accountant examination or Government examination of a university established or incorporated by or under a Central act, State Act or a Provisional Act or an Institution recognized by the University Grants equivalent examination.

Category 2: Administrative Officer (Special Branch).

By promotion from category 3(b) ie., Manager (Spl. Branch) in Anti-Corruption Bureau.

Must have put in 3 years of service as Manager (Special Branch) in Anti-Corruption Bureau.

Category 3(a): Asst. Director (Administration)

By recruitment by transfer of Supdt. in APMS in ACB

(i) Must have completed [three] years of service as Superintendent.  [Subs. by G.O.Ms.No. 75, GAD., Dt.15-3-95]

(ii) Must have passed the departmental test for clerks in Police Department.

(iii) Must have passed Accounts test for Subordinate Officers, Part-I.

Category 3(b): Managers (S.B.)

By recruitment by transfer of S.B. Assistants.

(1) Must have passed the following tests:

(i) Accounts test for subordinate Officers, Part I & II. 

(ii) Departmental test for clerks of Police Department.

(2) Must have put in four years of service as S.B. Assistant.
