ORDER:
 
Under the State Government Leave Rules, a maximum limit was prescribed for drawal of leave salary. But under Central Service Leave Rules of the Government of India, no such maximum limit of drawal of leave salary is prescribed. The Government after careful consideration have decided to adopt the above rule of the Government of India and amend the rules accordingly.
 
NOTIFICATION-I
In exercise of the powers conferred by the proviso to Article 309, read with article 313 of the Constitution of India, the Governor of Andhra Pradesh hereby makes the following amendment to the Andhra Pradesh Leave Rules, 1933 contained in the Annexure-III to the Fundamental Rules.
 
AMENDMENT
 In the said rules: -

(1) in rule 4, for the proviso to sub-cluse (i)(b) of (d) the following shall be substituted namely: -

 

An officer who proceeds on earned leave is entitled to leave 􀂨alary equal to the pay drawn immediately before proceeding on leave.

 

(2) in rule 28 for clauses (a) and (b), the following clauses shall be substituted, namely: -
 
"(a) While on earned leave, is entitled to leave. salary equal to his pay; while on half leave on medical certificate commuted into leave on full pay is, entitled to leave salary equal to twice the pay presented in rule 4 (d) (ii)”,

 

(b) While on leave on half pay either on medical certificate or on private affairs, is entitled to leave salary equal to half pay".

 
NOTIFICATION-I
In exercise of the powers conferred by the proviso to Article 309, read with article 313 of the Constitution of India, the Governor of Andhra Pradesh hereby makes the following amendment to the Andhra Pradesh Leave Rules, Revised Leave Rules, 1357 137 F. (1947) and Revised Leave Rules 1952 contained in Appendix XXI, XXII and XXIll respectively of the Hyderabad Civil Services Rules, Vol. II.

AMENDMENTS
I. In the old Leave Rules: -

(1) for article 214 of Appendix XXI, the following articles shall be substituted, namely: -

 

"214: An Officer on leave on private affairs shall, during such leave, receive a leave allowance equal to half the pay which he would have received if he were on duty on the post on which he has a lien.

 

(2) Notes (1) and Note (2) appearing under article 214 shall be omitted and Note (3) three to shall be re-numbered as Note: (1)

 

(3) In article 215 of Appendix XXI the expression "These Leave Allowances will be subject to the maximum of 0. S. Rs. 1,000/- and 500/- respectively'' shall be omitted.

 
II. For sub-rule (ii) of rule 16, of the Revised Leave Rules 1357 F. (1947) of Appendix XXII, the following sub-rule shall be substituted, namely: -
 

"(ii) A Government servant on leave on private affairs or leave on medical certificate is entitled to a leave salary equal to half the average pay drawn by him during the 10 complete months preceding the month in which the leave commences".

 
III. for sub-rules (2) and (3) of rule 15 of the Revised Leave Rules 1357 F (1947) in Appendix XXIII, the following sub-rules shall be substituted, namely: -
 
"(2) An officer who proceeds on earned leave is entitled to leave salary equal to the pay drawn immediately before proceeding on leave.

 

(3) An Officer on half pay leave or leave not due is entitled to leave salary equal to half the amount specified in sub-rule (1) or sub-rule (2) as the case may be".
