ORDER:
The Study Team has, among other things, made to the
Administrative Reforms Committee on Public Grievances the following
recommendations:
"Orders should
always in speaking orders i.e., self-contained and self-explanatory, should not
be terse. This will obviate the appellate authority calling for remarks and
thereby the delay or the time gap can be reduced".
2. The Study Team observed that quite a few orders of the
administrative authorities happen to be much too terse, though intended to serve
as communication they may invariably produce the impression of non-communicativeness.
Only orders were to be self-contained and self-explanatory (what as popularly
known as speaking orders) the process of conviction-listened for the recipient
of any decision / order will become too much simple and so much more effective.
If only orders were to be self-contained and self-explanatory, the appellate
authority or any higher-level authority could and should discontinue the
practice of calling for remarks as was done at present. That would result in
shortening the process of disposal of appeals and simplifying to process of
decision by the appellate authority.
3. Government after careful consideration, accept the
recommendation made by the Study team and direct that orders being issued by
the authorities concerned should be speaking orders i.e., self-contained, and
self-explanatory, and should not be terse.
4. All the Departments of Secretariat and Heads of Departments
should follow the above instructions scrupulously.
