ORDER:
In the reference 6th read above, the following individuals who have appeared for competitive examinations conducted by Andhra Pradesh Public Service Commission and got selection in the year 2010 as Asst. Section Officers in A.P. Secretariat Service have requested for pay protection and pensionary benefits in the old pension scheme.

2. Before entering into Government service, they had rendered service in the category of SGT /in M.Ps in the post falling under jurisdiction of local bodies with pensionary benefits in the old pension scheme, for the periods as detailed below:

The matter has been examined and it is observed that, in the reference 2nd read above, the services of teachers working in the schools under the control of Panchayat Samithies and ZPs were provincialised and as such the services of teachers working in ZPs and MP Schools were brought under AP. Educational Subordinate service governing teachers of ZPP/MPP in the reference read above.

4.  In the reference 4th read above, orders were also issued protecting their pay under F.R.22(a)(iv) with monetary benefit from the date of issue of orders.

5.  According to Rule 14(1)(2) Note 1 & 2 and Rule 26 of AP. Revised Pension Rules, 1980, a member of a service or services, who is selected for appointment by direct recruitment to another post, category or class in the same or different service is eligible for the benefits accrued to such member of a service or services in the previous post or post, except the lien or probationary right, as the case may be on such post or posts.

6.  As per Memo. reference 5th read above, the Finance (Pen.I) Dept., have clarified that all those cases where an in-service employee who was covered under the earlier pension rules joins another organization/Department, where the same rules were applicable, after submitting a technical resignation, such employees will be treated outside the purview of New Contribution Pension Scheme (NCPS). In other words, they would continue to remain under the earlier pension rules.

7.  In the light of above said orders and rules, Government after careful examination of the matter hereby order that the service rendered by the above ASOs as SG Teachers in various schools in various Districts shall count for the purpose pensionary benefits in continuation of their service in the Secretariat, under Rule 14(1)(2) Note 1 & 2 and Rule 26(1) of AP. Revised Pension Rules, 1980.

8. Necessary entries shall be made in the Service Register of the individuals with proper attestation. 9. This order does not require the concurrence of Finance (Pen.II) Department vide their U.O.No.27021/207/Al/Pen.11/2012, dt. 09.10.2012.
