Sub: M.A. & U.D. Department - Imposition of punishments etc. - Orders of the Tribunal etc. on the Government Orders - Certain Instructions - Issued - Regarding.

All the Heads of Departments are aware that disciplinary cases involve various lengthy procedures under A.P.C.S. Act. 1991 and A.P.R.P. Rules, 1980, which take long time to finalise the cases. They are also aware that only a few cases will come to the notice of the Government and out of these, only in a very few cases punishments are imposed after following due procedures. It is observed that after imposing punishments, the Delinquent Officers are challenging the punishments in the Courts of Law and tile Courts are granting stay or setting aside the punishments imposed by the Government. It is noticed that in most of the Court Cases, the concerned Head of the Department are not acting promptly by bringing the fact to the notice of the Government nor taking immediate action to file stay vacation petition in the same Court or an appeal against the judgment in the next higher Court.

All the Heads of the Departments are, therefore, directed to monitor the Court Cases periodically and file necessary stay vacation petitions and appeals against the judgments in the A.P. High Court immediately after the Court Orders are received and bring the fact to the notice of the Government or to furnish relevant material papers to Government in cases where the Government is the Competent Authority lo file appeals etc.

 
All the HODs are directed to follow these instructions scrupulously.
