In G.O.Ms.No.607, G.A.(Ser.A) Department, dt.6-11-1992, Government have issued an adhoc rule clarifying that, the Quota rota if any prescribed eighter in the special rules or in the adhoc/Rules shall apply only for determining the number of vacancies earmarked for each method of recruitment, but not for determining the inter-se-seniority of the holders of the posts, and this inter-se-seniority shall be determined in accordance with General Rule 33(a) and (h) of the State and Subordinate Service Rules. These orders were challenged in Andhra Pradesh Administrative Tribunal. The interim directions of the A.P. Administrative Tribunal dt.24-12-1992 in O.A.No.22/93 4-3-1993 in O.A.No.1103/93 was communicated to all the departments of Secretariat in U.O. Note No. 16/SER.A/93-6, G.A.D. dt.30-4-1993. Subsequently, the Hon’ble A.P. Administrative Tribunal in its orders dt.27-4-1995, held that, the adhoc rules framed in G.O.Ms.No.607, G.A. (Ser.A) department, dt.6-11-1992 are invalid and are accordingly declared void and quashed the same. The Government after examining the above orders of A.P. Administrative Tribunal carried the matter in appeal to the Supreme Court of India, against the orders of A.P. Administrative Tribunal dt.27-4-1995. The Supreme Court in their order dt.9-12-1995 in S.L.P. (Civil Nos.25247 to 25249 of 1995 have passed the following interim orders:-
"That pending the hearing and final disposal by this Court of the applications for stay after notice, the operation, implementation and execution of the judgement and order dt.27-4-1995 of the A.P.A.T. at Hyderabad in Nos.7642 of 1992 and 22 of 1993 and 1462.of 1994 be and is hereby stayed."
The above interim orders of the Supreme Court of
India are communicated to all Departments of Secretariat for information and
necessary action,
