CIRCULAR MEMORANDUM OF THE COMMISSIONER FOR COOPERATION & REGISTRAR OF COOPERATIVE SOCIETIES, A.P., HYDEARBAD

SUB: Cooperative Banks - Regulatory functions of the Registrar under the Cooperative Laws of the state - Certain instructions - Issued

In continuation of the circular instruction issued in the reference 1^st cited, following further instructions are hereby issued for the guidance of Dist. Coop. Officers and Divl. Coop. Officers in connection with discharge of Regulatory functions of the Registrar under the Act in respect of Coop. Banks in the state.

Accordingly, the following instructions are hereby issued in exercise of the powers of the Registrar conferred under Section 3 (2) of A.P.C.S. Act, 1964.

 

1. No amendment to the Byelaws (including Service Conditions of employees) of DCCBs, PACSs or Urban Coop. Banks shall be registered by the subordinate officers exercising powers of Registrar without the prior approval of the State Registrar.

 

2. No Inquiry under Section 51 or Inspection under Section 52 / 53 under the Act, shall be ordered in the affairs of Dist. Coop. Central banks or Coop. Urban Banks without the prior approval or express direction of the State Registrar. If any complaints or petitions are received against DCCBs / UCBs, the DCOs may call a preliminary enquiry at their level and based on the preliminary enquiry if statutory Inquiry or Inspection is called for, necessary proposals may be submitted by the DCOs to the State Registrar.

 

3. The DlCOs and DCOs shall not resort to giving approvals for the pay structure and pay fixations of the employees of PACSs / DCCBs since no such powers have been delegated to them under the Act as per the latest amendments made to the A.P.C.S. Act, 1964.

They should acknowledge the receipt of the circular.
