Sub:- Cooperation Department - APCS Act 1964 -Exercising of powers conferred under Section 32 (7)(a) of the Act by the Departmental Officers - Instructions issued.

The attention of the officers noted in the address entry is drawn to the subject and reference cited. They are well aware that as per Section 32(7) (a)(i) of APCS Act 1964, the Registrar is empowered to appoint PIC for a period not exceeding six months and any extension of the term of the PIC beyond six months Government approval is required.

In the reference cited, while highlighting the provisions of Sec 32 (7) (a) of APCS Act, 1964, instructions were issued to all the District Cooperative Officers, Divisional Cooperative Officers and District Cooperative Audit Officers in the state of United Andhra Pradesh that in all cases, where election could not be conducted within the period of six months for any pressing reasons, the officer who appointed the PIC shall submit proposal seeking prior approval of the Government well in advance i.e. at least 45 days before the expiry of the six months period to enable this office to submit proposals to Government. It was also instructed that any violation of the above instructions will be viewed seriously, and the erring official will be dealt with suitably under the disciplinary proceedings.

But it is noticed that the concerned Departmental Officers are extending the term of PIC beyond 6 months in violation of the provisions of Section 32(7) (a)(i) of APCS Act and subsequently sending proposals to this Office for ratification by the Government. It is very serious lapse on the part of the Departmental Officers.

Therefore, the Officers noted in the address entry are again instructed to follow the instructions issued in the circular cited strictly and any violation of such instructions will be viewed seriously, and suitable disciplinary action will be initiated against the concerned Officers.
