The attention of the all the District Collectors, Dy. Commissioners of Prohibition & Excise and the Prohibition ft Excise Superintendents in the State is invited to the reference cited. During a meeting with the Hon'ble Minister for Prohibition & Excise and the Hon'ble Minister for backward classes with the representatives of the tappers’ organizations on 07-08-2012. It was pointed out by the tappers representatives that certain delays were being experienced in the grant of new TCT/ TFT and also addl. counters under TFT.  It was said that the earlier practice of grant of addl. counters at the district level should be restored and the tappers should not be made to wait till permission from head quarter was received.

In this connection, Rule 3 of the Toddy Rules 2007 says that the Commissioner shall be competent to fix the number of Toddy shops to be established in area, their location, assignment of trees for tapping having due regard to requirement, public order, health, and safety.

After fixing of the number by the Commissioner, it shall be notified by the District Collector in the District gazette and Collector may allotted to TCS or TFT.

Certain applications from the tappers are being received in this office for permission to be allotted to tappers under TCS/ TFT.  Similar applications are being received in respect of inclusion in the existing TFTs also.

In this connection the right course of action as contemplated under the Rules and the practice followed earlier is as follows –

1. Establishment of new Toddy shop

In places where there are no toddy shops at present, the applicants shall be subjected to the routine tapping test, verification of nativity / residence / profession etc. and a formal proposal for the sanction of toddy shop in that place will be submitted by the Prohibition & Excise Superintendent to the Collector subject to availability of trees. A check memo designed for this purpose is enclosed herewith for the submission of proposals to Collector for approval. It shall be filled up after due enquiry, counter signed by the Dy. Commissioner and the proposal shall be submitted to the Commissioner by the Collector to establish a toddy shop the particular place.  Commissioner may give sanction under Rule 3. A notification shall be given in the district gazette under Rule4 and the Toddy shop shall be allotted to the tappers under the TCS / TFT schemes.

2. Inclusion of eligible tappers under TFT in the existing toddy shops (Addl. counters)


Rule 47 of the Toddy Rules says that every licensee be allotted not less than 30 trees per tapper. However, if there are more tappers in a village and not, adequate trees, the available trees are divided among the eligible tappers. Certain applications are being received for grant of addl. counters in the same toddy shop which has a license already and some tappers are selling toddy. In these cases, there is no need for the sanction of the Commissioner. The applicants shall be subjected to the routine tapping test, verification of nativity / residence / profession etc. and a formal proposal for the sanction of toddy shop in that place will be submitted by the Prohibition & Excise Superintendent to the Collector subject to availability of trees. A check memo designed for this purpose is enclosed herewith for submission of proposal to Collector. It shall be filled up after due enquiry, counter signed by the Dy. Commissioner and the proposal shall be submitted to the Collector for grant of licenses and inclusion in the existing TFT as addl. Counters.

In order to ensure that genuine tappers are granted licenses, certain check memos have been prepared for adoption by the field officers. These check memos will be completely filled up by the Prohibition & Excise Superintendents, Counter signed by the Dy. Commissioners and after satisfying himself of the requirements the Collectors are authorized to issue addl. counters under TFT to eligible tappers.

All the pending applications received in this office are herewith returned to the Dy. Commissioners for necessary action at their end.
