ORDER:

In the G.O. first read above, comprehensive rules viz., the Andhra Pradesh Public Employment (Recording and Alteration of Date of Birth) Rules, 1984 have been issued in regard to recording and alteration of date of birth in respect of Government Employees.

2.         In the G.O. second read above, the said rules were amended to the effect that these rules shall have effect not withstanding anything contained in any judgement, decree or order of a Civil Court in regard to the Alteration of date of birth in the School or the University records whether or not the Government is a party to such proceedings.

3.         Of late, persons are resorting to the practice of recording lesser age than actually they are or as the case may be, the older age than actually they are while entering into schools for overcoming the problem of the prescribed age limit, while appearing for the S.S.C. Public Examinations and accordingly entering into Government service. After securing jobs, persons are agitating for correction of date of birth in the school records by various means in the first instance and basing on that claiming for alteration of date of birth in the service records, for continuing in the service for a longer period and consequential benefits thereupon. Thus, such persons are gaining double benefits both at the time of admission into schools and at the time of attaining the age of superannuation in service.

4.         It has been felt necessary in public interest, to forestall such undue advantages being gained by such persons. After careful examination of the whole issue, it has been decided by the Government to amend the Andhra Pradesh Public Employment (Recording and Alteration of Date of Birth) Rules, 1984, suitably so that any representation/claim for alteration of date of birth in the service records basing on the subsequent change in the school records shall not be entertained.

5.         Accordingly, the following notification shall be published in the Andhra Pradesh Gazette.

NOTIFICATION

In exercise of powers conferred by the article 309 read with article 313 of the constitution of India, the Governor of Andhra Pradesh hereby makes the following amendments to the Andhra Pradesh Public Employment (Recording and Alteration of date of birth Rules, 1984).

2.         The amendments hereby made shall be deemed to have come into force with effect from 21-4-1084.

AMENDMENT

In the said rules.

1) In mule 2, for sub-rule (5), the following shall be substituted, namely:


"(5) The date of birth as determined on the basis of the school records or any proof produced at the time of entering into service and entered in the service record shall be final and no subsequent variation of date of birth in the school records for any reason, shall be relevant for the purpose of service and on that basis the date of birth entered in the service records shall not be altered except in the case of bonafide clerical error, under the orders of the Government."

2. The rule 4 shall be renumbered as sub-rule (1) of the said rule and after the sub-rule so renumbered, the following shall be inserted, namely:


"(2) No subsequent variation of the date of birth in the school records shall be relevant for the purpose of service nor shall such variation be a valid ground for ordering an alteration of the date of birth by any Court, Tribunal or other authority.”
