ORDER:

In accordance with the orders issued in the G.O. first read above the School Assistants working in Government schools had to pass the following tests for regularisation of their services within a period of 4 years from the date of their appointment.
 
1.
Persons appointed to Categories I and I- A and Grade-I and II of Category-2 of Class-II

 

i) Deputy Inspector's Test
 
ii) Accounts Test for Subordinate Officers part-II
 
iii) Special language Test for Officers of the Education Department (Advanced standard) in Telugu.
 
iv) Special Language test for Officers of the Education Department (Higher standard) in Hindi or Urdu.
 
2.
Persons appointed to Category-2 of Class-III

 

i) Deputy Inspectors Test

 

ii) Accounts Test for Subordinate Officers Part-I

 
2. Orders were subsequently issued vide G.O. 2nd read above, dispensing with the tests prescribed above for regularising of services of school assistants but the above tests were prescribed to become eligible for promotion to the Higher Posts. Later, in the latest orders issued vide G.O. 4th read above, the tests mentioned above were not prescribed to the School Assistants either for regularisation of their services or their promotions. Not only that, these tests were not prescribed for any of the officers and APSESS or APES.

3. The services of teachers working in Zilla Parishad, and Government Schools were integrated vide G.O. 3rd read above. These orders were challenged by the Government teachers in the APAT and the Tribunal directed not to act in the rules framed under G.O.Ms.No. 40, Education, dt. 7-2-1992 till the rules are framed afresh. Accordingly, the A.P. School Education Sub-ordinate Services Rules were framed afresh vide G.O. 4th read above, and these orders were upheld by the Tribunal.

4. The Commissioner and Director of School Education, in his letter 5th read above, stated that certain Zilla Parishad High Schools were upgraded into Junior Colleges in the 70 and the School assistants working in Zilla Parishad Schools were absorbed in Government Junior Colleges with the condition that 50% of the service rendered by them in Zilla Parishads shall be taken into consideration for seniority, in Government Schools. He further stated that certain School assistants working in Government Schools of Nalgonda District represented to him that they also be considered for promotion to the Higher posts taking into the consideration the length of service along with teachers working in Zilla Parishad Schools. The Commissioner and Director of School Education, therefore requested the Government to consider the request of teachers working in Government Schools and issue orders to consider their entire service as a Teacher for seniority purpose for promotion to the Higher post on par with the teachers working in Zilla Parishad/Mandal Parishad Schools.

5. The Commissioner and Director of School Education in his subsequent reference 7th read above stated that since the services of teachers working in Government/Zilla Parishad/Mandal Parishad are integrated, their integrated seniority list were prepared in the districts taking into consideration the dates of their regularisation of services. The contention of the teachers working in Government Schools is that their services should also be regularised with effect from the dates of their joining into service without insisting on passing of departmental tests as was done in respect of teachers working in Zilla Parishad/Mandal Parishad Schools. In view of this, the Commissioner and Director of School Education suggested that the services of School assistants working in Government Schools who are still working as School Assistants may be regularised with affect from the dates of their joining into service subject to the condition that they should not claim any monetary benefits and service benefits with retrospective effect and such benefits will be extended to them with prospective of the date of issue of Government orders and requested the Government to issue necessary orders in the matter.

6. The Government have examined the matter very carefully and decided that the services of School Assistants who were still working in the same category in the Government Schools should be re-regularised with effect from the date of their joining into service subject to the condition that they should not claim any monetary benefits on account of re-regularisation of Services but to accord them the service benefits from the date of re-regularisation on par with the School Assistants working in Panchayat Raj Institutions. The Government therefore, in accordance with rule 34 of A.P. State and Sub-ordinate Services 1996, hereby order that the services of those who are still working as School Assistants in Government Schools shall be re-regularised with effect from the date of joining into service without insisting on departmental tests mentioned in para one of this order with all service benefits except monetary benefits on par with the School Assistants working in Panchayat Raj Institutions.
