Sub: Leave on Half Pay
- Encashment of Leave on half pay at the time of retirement of Government
Employees - certain clarification issued.

According
to the Government Order 1st cited, State Government Employees
drawing pay up to the scale of Rs. 3110-6380 are eligible for dearness
allowances at full rates. Thus, for the purpose of encashment of leave on half
pay at the time of their retirement, as per orders issued in the Government
Order second cited, the employees in the above scale and below are entitled for
full Dearness Allowance on encashment.
In
the Government Order 3rd cited, further orders have been issued,
among others, that only proportionate dearness allowance as admissible to the
leave salary on half pay, has to be taken into account to all the categories of
employees, for the purpose of encashment of leave on half pay.
In
this connection, it has been brought to the notice of the Government that in the absence of clear instructions in
the Government Order 3rd cited
as to the effective date for the applicability of orders issued at para
11, the sanctioning authorities are
using their own discretion by allowing full rates of Dearness Allowances in some cases and
allowing only proportionate Dearness
Allowance in some other cases, while sanctioning encashment of leave on half pay, in respect of cases of
retirements between 30.03.1994 and
27.10.1998.
Government,
therefore, after careful examination of the matter hereby clarify that orders
issued at para 11 of the government order 3rd cited have prospective
effect only i.e., with effect from the date of issue of the above orders.
