The Secretary, Andhra Pradesh Public Service Commission, had informed earlier that as per Rule 22 of A.P. State & Subordinate Service Rules, reservation to an extent of 3% is applicable to the physically handicapped persons and it will automatically be observed unless a restrictive provision is made in the Special Rules, and accordingly, all the physically handicapped candidates i.e., Blind, Deaf and Orthopaedically handicapped will have claim for selection against the vacancies reserved for them including the posts which are of executive nature. He has therefore, sought for a clarification whether the totally blind candidates are eligible to apply for the posts in State Service, keeping in view of the duties and responsibilities attached to those posts. Accordingly, the concerned Departments in Secretariat in whose Special Rules for the posts, there is no restriction on the Physically Handicapped including Blind from applying and claiming the benefit under rule 22 of A.P. State & Sub-Ordinate Service Rules, were requested to offer their remarks. Most of the Departments have expressed their unwillingness for appointment of P.H. candidates including Blind to the post which are of executive nature.
2. The Secretary, A.P. Public Service Commission in his letter 2nd cited, has now informed that, much confusion is created in the matter of reservation/eligibility to physically handicapped persons due to inadequate nature of the provision in the relevant rules, and therefore desired to indicate in the rules, about the eligibility of P.H. candidates and also percentage of deformity of Blind, Deaf and Dumb and Orthopaedically Handicapped to hold such posts.

In this connection, it may be stated that Government have issued orders in G.O.Ms.No.115, Women Development & Child Welfare Department, dated 30-7-1991 trifurcating 3% reservation in favour of physically handicapped in public Service in the ratio of 1:1:1 to Blind, Deaf and Dumb and Orthopaedically Handicapped. In the said order it was also indicated that where any Department consider it not possible to provide reservation for any category of Handicapped persons, the extent of reservation in view of the nature of the duties expected to be performed by the employees in that particular Department could be partly or fully exempted from this split of reservation. The grant of such exemption shall be decided by an inter departmental Committee constituted in G.O.Ms.No.18, Women Development & Child Welfare (WH.Desk) Department, dated 1-3-1994 with the following:

4. Accordingly, the Departments in whose Special Rules, for the posts, there is no restriction on the P.H. from applying and claiming the benefit under Rule 22 of A.P. State & Subordinate Service Rules and who seek exemption from the split of reservation, as ordered in G.O.Ms.No.115, Women Development and child Welfare Department, dated 30-7-1991 may place their proposal before the above committee constituted for the purpose and amend their Special Rules to that extent.
5. All the Departments of Secretariat and Heads of Departments are requested to follow the above instructions while making such provisions in their Special Rules.
