The
Government have received representations for allowing State Govt. Employees to
take extraordinary Leave with permission to take up employment abroad i.e., in
foreign countries.
1. Government
employees desirous of seeking jobs abroad, irrespective of categories to which
they belong technical. non-technical or clerical be permitted to apply and
secure employment abroad without applying for voluntary retirement or resigning
from service. However, such of those scarce categories of staff / officers
whose services are considered essential to this Government shall not be permitted
to secure job abroad.
2. The period of
absence during employment abroad will be treated as extraordinary leave without
allowances but such period of absence will not be construed as a break in
service. It will not be counted for service benefits such as increment, pay,
leave etc. However, if contribution towards pension is paid by the foreign employer
or employee such periods will count for pension.
3. That no
Government dues are pending recovery from the Government Servant.
4. That no prosecution is pending or contemplated in the Court of Law against the Government Servant.
5. If the absence
of the employee exceeds five years be ceases to be a Government Servant.
6. On return from
leave the Government employee shall not claim any preference over others in
their parent the department for promotion or higher pay by virtue of the
experience gained in foreign employment.
7. All Government
Servants may opt voluntarily to this scheme.
8. There shall not
be any compulsory clement and Govt. Servants with 5 years regular service only
shall be eligible to avail the scheme.
9. The benefit of the scheme shall be given to Government Servants once in the entire service.
10. The Government
Servant should obtain specific permission from the Government before he
undertakes any employment abroad.
11. The scarce
categories mentioned in item (I) shall be identified, and a list shall be
prepared and maintained by each Head of Department with the prior approval of
the Government. The list shall he updated from time to time based on the
emerging needs and experience.
