Instructions laying down the guidelines for convening the meetings of the D.P.Cs. for preparing panels of Heads of Departments, Addl. and Joint Secretaries to Government (Non-Cadre) and other categories of posts and above the third level Gazetted posts appointment to which is outside the purview of the A.P.P.S.'C. were issued in the G.O. first cited. In the said G.O. a proforma was also prescribed for furnishing the information to the D.P.Cs. In the reference second cited, orders were issued dispensing with the zone of consideration, the principle of grading and preparation of half-yearly panels.  
 
Orders were issued in the reference third cited, to' the effect that the Reporting office should forward the Confidential Reports by the 15th April of every year and the intermediate authorities will pass on the report with their remarks to the next higher authority within one week of its receipt by them. It has also been ordered therein that the reports should reach the Heads of Departments not later than the 15th May and the Secretariat Departments concerned not later than the end of May every year, Instructions have also been issued in the G.O. fourth cited prescribing the number of years for which the annual confidential reports are to be considered by the D.P.Cs. for assessing the suitability of officers to be considered for promotion.
 
According to General Rule 4 (a) (i) (ii) as amended in G.O. Ms.No. 438. General Administration (Services. D) Department, Dt: 16-7-90 the list of approved candidates for recruitment by transfer to a service or a class of service in any case, where the Commission is not consulted on the suitability of a candidate for such I appointment under Article 320 of the Constitution of India or for promotion shall be prepared ordinarily during the month of September every year on the basis of estimate of vacancies for that year. The panel so prepared shall ceased to be in force on the afternoon of the Thirty first August of the succeeding year. It is also laid down in the above rule that First September of every year shall be reckoned as the qualifying date to determine the eligibility of candidates for such appointment and the number of candidates to be considered shall be equal to the number of estimated vacancies.
 
Inspite of clear orders and instructions in the references cited it has been observed that the D.P.Cs. are not able to meet on the due dates for preparation of draft panels for purposes of promotion as the particulars required to be placed before them are more often not ready or available with the Departments. With a view to avoiding delay in holding the meetings of the D.P.Cs. regularly on the due dates action as out lined below should be followed for convening the meetings of the D.P.Cs. keeping in view the instructions issued in the references cited; -

1. A certificate should invariably be recorded by the appointing authority that no vacancy is available in case no panel is required to be prepared for a particular panel year.

OR
that the appointing authority does not consider it necessary to prepare a panel for a particular year.
 
2. The estimate of vacancies should clearly be made in accordance with the provisions of General Rule 4(a) (i) (ii)
 
3. The number of candidates to be considered shall be equal to the number of vacancies estimated
 
4. The meetings of the DPC/DPCs. Should invariably be held on the date/ dates fixed by the Departments of Secretariat concerned in consultation with the General Administration (DPC) Department
 
5. Well in anticipation of the meeting of the DPC atleast 3 months in advance the C.Rs. of all those whose cases have to be considered at the next meeting of the D.P.C. should be updated
 
In view of the instructions issued in the references third cited it should not be difficult for the Departments to get the C.Rs. of the Officers concerned up-dated. There should be no occasion for the meeting of the D.P.C. not being able to be convened/postponed on account of non-availability of C.Rs.  
 
The Departments of Secretariat are requested to keep the above instructions in view and take immediate advance action for fixation of calendar of D.P.C. meetings in so far as the Departments/Services under their control are concerned in consultation with the General Administration Department immediately.
