ORDER:
In the letter cited, the secretary, Andhra Pradesh
Public Service Commission, has stated, among other things, that Telangana area
is regarded as a separate unit for recruitment to subordinate Services on and
after 1-11-1956 and a separate list of candidates is drawn up by the Commission
in all cases of direct recruitment following the rule of reservation. He has
also stated in the case of offices of the Heads of Departments and Secretariat,
the second out of every ·three vacancies, should be given to a candidate
possessing the domicile qualification of 5 years' residence in the Telangana
area, whereas in the case of other offices, recruitment is made not with
reference to the Proportion of 2:1 but with reference to the vacancies arising
in the respective areas. In view of the above, he has enquired as to how to
determine the inter-se-seniority f candidates selected for
the same category of posts in both the areas inter-se-seniority of candidates
holding posts of cooperative sub-Registrars etc, which are of a State wide
nature, for the claims of both Andhra and Telangana candidates have to be
considered for promotion to the next higher category of posts.
2. All direct
recruitment after 1-11-1956 is governed by Andhra Pradesh Service Rules.
Candidates recruited to Subordinate Services in the Telangana area on and after
1-11-1956 are therefore, Governed by the Andhra or Andhra Pradesh Service
Rules. According to General Rule 85(a), which applies to both Andhra and Telangana
Regions on and from 1-11-1956, the seniority of a person in a service class,
category or grade shall, unless he has been reduced to a lower rank as a
punishment should be determined by the date of his first appointment to such
service, class, category or grade. The Government therefore direct that the
inter-se-seniority of Andhra and Telangana personnel recruited to each of the
regions separately should be determined according to the above general rules.
In case where the dates of their first appointment to a particular category to
be the same, the persons concerned may be taken into account for determining
their inter-Se-seniority, a person having more age may be declared as senior to
the person having less age, but there may be certain cases where the ages of
the persons concerned may be the same. In such a case·, the concerned authority
may be permitted to use his discretion to fix their inter-se-seniority.
3. Necessary
amendments to the General Rules for the State and Subordinate Services and the
special Rules for the Services General Administration (Services.D) and the recruitments
of the concerned respectively.
